One of the best lessons I’ve learned over my career as an investment analyst is the myth of excellent management or “great execution” is really just that – a myth.

When I see companies in troubled industries reporting quarter after quarter of great results, while all of their peers are getting killed, I know a fraud is going on. I remember in the early 2000s, WorldCom kept reporting profits when all of the other long-distance carriers were getting killed. I knew it couldn’t last. And it didn’t. WorldCom’s accounting was revealed to be a fraud – the company was counting its network access costs as capital expenses. Once the real numbers came out, the company collapsed in what was the largest bankruptcy in American history at that point.

About three years ago, I saw Goldman Sachs reporting quarter after quarter of unbelievable results when all of the other investment banks were hurting. I spent a lot of time looking at its numbers – which didn’t make any sense. It reminded me of Enron. It kept reporting bigger and bigger profits, but lost more money every year in cash. And its debt balances kept growing.

I wrote a lot about this in The Digest, but I never officially recommended shorting Goldman in my newsletter because I literally couldn’t figure out how Goldman Sachs was doing it. I couldn’t find the smoking gun… but I knew a giant fraud would be discovered there, eventually.

In October 2008, I figured out part of the big secret: Goldman had insured all of its subprime exposure via AIG. This allowed it to book huge profits on its subprime investments long before they were actually paid off because the bonds were insured. Of course, it was all a sham – AIG didn’t have nearly enough money to pay off any of the insurance. (See the October issue of PSIA for more details.) A source close to the company even told me how big the exposure to AIG really was – $20 billion. That’s roughly 100% of the profit Goldman claimed in 2006 and 2007, at the height of the credit bubble. Goldman completely denied my report and claimed it had zero exposure to AIG.

As was subsequently revealed in the spring of 2009, my report was right on the money. Goldman had roughly $20 billion in exposure to AIG and received roughly $14 billion of money the federal government used to bail out AIG.

But I completely missed one big part of the story… And once this fact becomes common knowledge, it will probably mean jail time for several leading Goldman executives and the end of the firm. What did I miss? The entire Goldman-AIG relationship was a complete sham. Let me explain…

Goldman eventually admitted it had insured roughly $20 billion worth of subprime CDOs with AIG and had major exposure to the firm. But the New York Federal Reserve and Goldman Sachs never revealed this critical fact: Goldman didn’t merely buy insurance on a bunch of random subprime CDOs. It actually bought insurance on special CDOs it had put together and sold to its own clients. In other words, Goldman knew more about these CDOs than anyone else. Goldman bought insurance on these CDOs because it knew they’d collapse.

This is tantamount to building a house, planting a bomb in it, selling it to an unsuspecting buyer, and buying $20 billion worth of life insurance on the homeowner – who you know is going to die!

These facts all came to light because of research done by the office of Darrell Issa, the ranking Republican on the House Committee on Oversight and Government Reform. These new documents will certainly lead to a full investigation of the Goldman-AIG dealings and the subsequent $180 billion bailout led by the New York Federal Reserve. My bet? Heads will roll. If you own Goldman Sachs, you’d better sell.

No surprise there. Both AIG and Goldman Sachs rate right up there with all the bailed out companies.  They caused the Financial crisis and the taxpayer foots the bill and still no real investigation or audits have been done. Even the Fed refused to let auditors in.

It’s sad but not a surprise that we don’t hear so much as a peep from our Government or the United States over the assassination of Hamas leader Mahmoud al-Mabhouh.

Could you imagine the world outrage if Hamas stole the passports from other countries’ citizens to use as cover for an execution squad?

Imagine the shrill condemnation if they tricked an Israeli military leader to travel to another country where he or she was ambushed and throttled to death.

Imagine a death squad of up to 26 assassins infiltrating a neutral country to carry out such an atrocity.

It seems we can’t get over the myth we’ve created of the little plucky nation of Israel defending itself against the Islamic hordes intent on destroying them.

The fact is Israel has the fourth largest military machine in the world and is the only nuclear power in the region.

Israelis think it’s acceptable to have their country, that was built on the theft of land and the homes of the original inhabitants and that imprisons the entire Palestinian people, and then arm themselves with nuclear missiles to intimidate any country that objects.

It is the sole superpower in the region backed up by the only world superpower. It’s a different story for Iran, which has its two closest neighbours invaded and occupied by massive hostile armies.

It is surreal that our news of the killing of al-Mabhouh is focused on passport thefts rather than the cynicism of a rogue nation that feels a God-given right to assassinate its enemies as it sees fit.

The posturing from those nations, who had their citizens’ identities used as aliases for terrorism, is pathetic.

The best they could come up with is calling in the Israeli ambassador for a telling off. Without doubt, these victims of passport theft will be on the international terrorist watch list whenever they travel.

When their governments are pushed about what actions will be taken against Israel for putting their citizens in danger, they retreat into gobbledygook. Israel is already gloating that these protests are just for show and will die down soon enough. That is until next time it decides to murder someone.

The international media seem more interested in the mechanics of murder. There’s certainly no discussion about sanctions against Israel or calling for the murderers to be extradited to face justice.

It is almost accepted that it’s okay for Israel to entrap and murder its enemies as some sort of pre-emptive strike.

I will assume al-Mabhouh was indeed a leader of Hamas prepared to import arms into Gaza. But this is a land where almost a million and a half citizens are walled off from the rest of the world by Israel and being bled into submission. Nothing goes in and nothing out.

The Palestinian people there are in desperate peril, yet the rest of the world ignores their plight. When these people try to fight back with home-made bombs they are invaded, their civilians massacred and their homes levelled.

Israel keeps the media away, then denies its atrocities and attacks anyone who tries to tell the truth.

So Palestinians see people like al-Mabhouh as freedom fighters fighting for them.

The twisted and ugly truth is Hamas was actually created and funded by Israel to undermine the secular, nationalist Fatah. Now it’s backfired.

Fatah would do anything for a deal with Israel, but can’t because of Hamas.

So everyone in Israel and Palestine is stuck in a revolving nightmare with no end.

Peace will only come when Israel admits it has visited a monstrous evil against the land’s indigenous people and that a genuine settlement can only be reached if it gives up some of its stolen land, pays compensation for the rest and recognises an independent state of Palestine.

Instead it thinks it can continue to use brute force to impose its will on the weak and hunt down and murder those who dare to fight back.

This is a nation gone mad. It’s worse than terrorism.

On March 10, in the Israeli city of Haifa, American peace activist Rachel Corrie will get her day in court. Corrie’s parents, Cindy and Craig Corrie, are bringing suit against the Israeli defence ministry for Corrie’s killing by an Israeli military bulldozer in Gaza in March 2003.

Four key American and British witnesses who were present at the scene – members of the International Solidarity Movement – will be allowed into Israel to testify, despite having been barred previously by the Israeli authorities from entering the country. This reversal by the Israeli authorities is apparently due to US government pressure, The Guardian reported. (Three cheers for any US officials who contributed to this pressure. What else could you make the Israeli government do?)

A Palestinian doctor from Gaza, who treated Corrie after she was injured, has not been given permission by the Israeli authorities to leave Gaza to attend. (This would seem to be important testimony concerning the nature of Corrie’s injuries – did US officials exert pressure for his appearance?)

This case isn’t just about accountability for Corrie’s death. It’s a test case for the power of the rule of law in Israel, when the rule of law comes into conflict with the policies of military occupation.

When the rule of law in Israel comes into conflict with the policies of occupation, the rule of law often loses. But it does not always lose, particularly when the rule of law gets a boost from vigorous protest and political agitation. This month, Reuters reported Israel began rerouting part of its “West Bank barrier” near the village of Bilin – the site of many Palestinian, Israeli and international protests – in response to a petition filed in 2007 by Palestinians whose land was confiscated for the project. This was only a partial victory, because it only affected a minority of the confiscated land. But it shows that the rule of law in Israel is not totally impotent against the occupation, particularly when the rule of law is aided by protest and agitation.

It’s also a test case for the power of nonviolent resistance to the Israeli occupation. It’s commonplace among some poorly informed commenters – Edith Garwood of Amnesty International cited Bono, New York Times columnist Nicholas Kristof and President Obama as recent examples – that Palestinians should “find their Martin Luther King.” But this commentary is foolish and retrograde, as Rahm Emanuel might say. A necessary condition for the ascendance of a King- or Gandhi-type movement in Palestine is that if Palestinian nonviolence activists are killed by the Israeli occupation, the government of Israel pays a significant price for that killing. If the Israeli government can kill an American peace activist and pay little price, what chance do the Palestinian Kings and Gandhis have?

It’s instructive to do a press search on the recent developments in the Corrie case. Searching on Yahoo News, I found Israeli and Palestinian press, Jewish and Arab press, British and Australian press. But outside of The Seattle Weekly – Corrie is from Olympia, and Brian Baird is her representative – I found no general US press. Isn’t it remarkable that we Americans have to read the British press to find out about developments in the case of our compatriot? Isn’t this state of affairs something that Bono, Nicholas Kristof and President Obama ought to reflect on, especially given the fact that they have significant ability to do something about it?

The persistence of Corrie’s case as a thorn in the side of the Israeli occupation authorities recalls the 1960s Costa-Gavras docudrama “Z,” about the political fallout from the assassination by the US-supported Greek government of the Greek parliamentarian and peace movement leader Gregoris Lambrakis. There is a powerful scene in the movie in which one of Lambrakis’ associates visits Lambrakis’ widow to deliver the news that four high-ranking military police officers have been indicted in the killing. On the way to meet her, Lambrakis’ associate passes a group of Greek students painting the letter “Z” on the sidewalk, meaning “he (Lambrakis) lives.” Marveling at the students’ determined activism in the face of mounting repression, Lambrakis’ associate said, “It’s almost as if he were alive.”

They murdered her, and yet she dogs them. It’s almost as if she were alive.

Investigators arrive in Israel as Dubai authorities find DNA at murder scene

Investigators from Britain’s Serious Organised Crimes Agency (Soca) have arrived in Israel to start interviews with dual nationals whose names were used on fraudulent passports used by the assassins of a Hamas commander last month.

Soca confirmed yesterday that arrangements were already being made to speak to the six British-Israeli dual nationals whose names appeared on the 11 passports originally revealed by Dubai police last week to have been used by members of the hit squad. Meanwhile, police in Dubai said that they had moved a step closer to identifying the murder suspects by finding DNA and fingerprints at the scene of the crime.

The planned interviews are part of the investigation into the use of the falsified passports ordered by Gordon Brown after the revelation of their use in the operation to kill Mahmoud al-Mabhouh in his Dubai hotel room.

Dubai’s police chief, Lt Gen Dahi Khalfan Tamim, has said he is “99 per cent sure” that Israel’s foreign intelligence agency Mossad was responsible for the assassination. And yesterday he told the Al-Arabiya news network that new evidence had emerged in the hotel where Mr Mabhouh died. “We’ve (identified) traces of DNA on the scene, belonging to the criminals,” he said. “We have fingerprints and DNA traces.”

Israel, whose ambassador in London Ron Prosor was called into the Foreign Office after the original disclosures, has refused to confirm or deny any involvement.

Soca said yesterday it was “arranging to speak to six passport holders as possible witnesses to a crime”. It said interviews would take place in the British Embassy in Tel Aviv and added: “The Israeli authorities have been informed.” A spokesman for the British Embassy said an investigator from the British agency had arrived in Israel but indicated that interviews had not yet begun.

Soca enquiries are likely to include interviews with another six British passport holders whose names were among those used by a further 15 suspects in the assassination revealed by Dubai police this week. The agency said it was “working closely with the Emirates”. This week’s announcement brought to 26 the total of suspects being sought by the Dubai authorities for the killing.

Lt Gen Tamin was also quoted as saying that he expected details of the 15 new passports identified in the case to be circulated by Interpol as the 11 others already have been. He told the United Arab Emirates-based newspaper al-Bayan that he was working with European countries, Australia and the US through diplomatic channels to establish an international detection team “from at least seven countries”. He added: “Friendly nations who have been assisting in this investigation have indicated to the police in Dubai that the passports were issued in an illegal and fraudulent manner.”

ONE of the six ‘Irish’ suspects in the assassination of a Hamas commander in Dubai changed her hair colour while on the mission, new video footage reveals.

The suspect, who used the name Ivy Brinton and had a false Irish passport, can be seen sporting both dark and blonde hair in the footage released by authorities in the United Arab Emirates yesterday.

The footage, from the hotel where Mahmoud al-Mabhouh was killed last month, reveals how the suspect either dyed her hair or wore a wig in an effort to conceal her identity — going blonde halfway through the mission.

It shows her accompanied by another suspect, who used the name Chester Halvey and also travelled on a forged Irish passport.

A third suspect who used a false Irish passport was also shown on footage released yesterday. The woman, using the name Anna Shauna Clasby, was filmed leaving the hotel, the Jumeirah Emirates Towers, on the day of the killing.

The release of the footage and other information by the Dubai authorities has cranked up international pressure on Israel over the assassination.

Dubai’s police chief Lieutenant General Dahi Khalfan Tamim says he believes the Israeli secret service Mossad was responsible. Israel has refused to confirm or deny involvement.

Speaking on a visit to Gaza yesterday, Foreign Affairs Minister Micheal Martin said: “We are very angry at the fraudulent use of information that was stolen from valid Irish passports to make forged passports.

“These people were not Irish citizens. Whoever did this forged the passports. We’re angry about that because it violates the integrity of our passport system and also places at risk the security of our citizens.”

Forged British, French, German and Australian passports were also used by the suspects.

Australia yesterday summoned its Israeli ambassador to a meeting to explain the affair.

The operation to kill Mr al-Mabhouh came just five years after an Israeli diplomat was expelled from Australia after a Mossad operation to fraudulently obtain Australian and New Zealand passports was uncovered.

Although a garda investigation has been launched into the use of Irish passport information, senior gardai said last night there were no plans to send an officer to Dubai. But gardai are liaising with Interpol and police forces in the other countries affected.

At the time of his murder, Mr al-Mabhouh was wanted by the Israeli, Egyptian and Jordanian governments. He died after being electrocuted with a stun gun and smothered to death with a pillow.

Dubai police believe he was followed to his hotel room by members of the assassination squad wearing fake beards, wigs and other disguises.

Authorities did not know he had been murdered until after a post-mortem examination. Source

The first heavy rains have hit Haiti since last month’s devastating earthquake struck, swamping makeshift camps that house hundreds of thousands of homeless and raising fears of landslides and disease.

The rains late on Thursday came as forecasters warned of a large storm heading in Haiti’s direction that could strike over the weekend.

More than a million people were made homeless by the deadly January 12 quake, many of them now living in flimsy makeshift shelters that offer little protection from heavy rains.

Relief workers say the approaching wet season and the hurricane season later this year will likely add to misery for quake survivors struggling to rebuild their lives.

Even before the quake Haiti often suffered badly during the rain and hurricane seasons as a result of its poor infrastructure.

In 2008 a series of storms killed more than 800 people.

Now in the capital Port-au-Prince, some 770, 000 quake survivors are living in makeshift camps and with the onset of rains, the threat of disease and infection poses another great challenge.

‘Huge challenge’

“We have a huge challenge in terms of just providing emergency shelter – something that we feel that if we put all of our weight behind, as we are doing right now, we will be able (to do),” Kristen Knutson, a spokeswoman for the UN office that is coordinating the international relief effort, told Reuters news agency.

Thursday’s deluge hit as relief officials changed strategy on dealing with quake survivors, delaying plans to build big refugee camps outside the capital.

Instead, they want the homeless to pack up their tents and return to destroyed neighbourhoods.

Gerald-Emile Brun, an architect with the Haitian government’s reconstruction committee, told Reuters that “everything has to be done before the start of the rainy season, and we will not be able to do it”.

Brun also suggested that Haitians may largely be left to fend for themselves.

Haiti meanwhile is continuing to count the economic cost of the quake.

Call to cancel debt

On Thursday the country’s president, Rene Preval, said government assessments had indicated that the disaster would cost the already poor country up to 50 per cent of its gross domestic product.

“This earthquake… led to the deaths of 200,000 to 300,000 people and destroyed from 35 to 50 per cent of the GDP,” he said.

Preval was speaking reporters after meeting Luiz Inacio Lula da Silva, his Brazilian counterpart at a UN-Brazilian military base in Port-au-Prince.

During his brief visit, Lula called on the international community to cancel Haiti’s debt, and officials from the two governments signed agreements to aid Haitian farmers and schools, which were hard hit in the quake.

According to the United Nations, 5,000 schools were damaged or destroyed in Haiti, which was already the poorest country in the Western Hemisphere before the catastrophe struck.

Lula also referred to a recent South American summit’s pledge of $300m in aid for Haiti, including an agreement to create a $100m fund to help the government with immediate needs. Source

Update February 25 2010: Apparently there were also a few more people involved. Some used Australian passports.

Mounting diplomatic fury over the killing of a top Hamas commander in a Dubai hotel reached Australia on Thursday, with Israel’s ambassador summoned over the use of Australian passports by a suspected assassination squad.

Dubai authorities have now identified 26 people suspected of involvement in the killing of Mahmoud al-Mabhouh, with three using forged Australian passports named among 15 new suspects, most of them Europeans.

“Any state that has been complicit in use or abuse of the Australian passport system, let alone for the conduct of an assassination, is treating Australia with contempt and there will therefore be action by the Australian government in response,” said Australia’s Prime Minister Kevin Rudd, without elaborating.

Now they are looking at 26 perpetrators as opposed the the 11 previous suspects. Concern over fake passport use should be  in the forefront as Mossad has a long history of such use of passports.

Finally some are now becoming aware of  forged or stolen document use. I just have to wonder what took everyone so long to finally do something about it? This has been ongoing for years.

Report: PM approved Dubai assassination in early January

Prime Minister Benjamin Netanyahu authorized in early January the assassination of Hamas commander Mahmoud al-Mabhouh, according to a report published in the Sunday Times.

Based on information obtained from “sources with knowledge of Mossad,” the paper reported that Netanyahu gave Mossad chief Meir Dagan the green light for the Dubai operation during a meeting at the Midrasha – the intelligence agency’s headquarters, in the northern suburbs of Tel Aviv.

The sources also said that the Mossad hit squad trained for the Dubai mission by secretly rehearsing in a Tel Aviv hotel.

Netanyahu reportedly told the Mossad agents, “The people of Israel count on you. Good luck.”

Meanwhile, Dubai police chief Dahi Khalfan Tamim said that an internal Hamas source leaked information to Mabhouh’s assassins that led to his killing, Israel Radio reported.

Speaking to Persian newspaper Gulf News, Tamim said that the aide, whose identity was not revealed, was the only person who knew about Mabhouh’s visit to the emirate.

Meanwhile, Hamas on Saturday again blamed Israel again for the hit. At a press conference, Salah al-Bardawil, one of the group’s Gaza-based leaders, said he does not suspect that the Palestinian Authority was involved in the killing and that the entire affair was the responsibility of Mossad.

However, the Hamas official said the two Palestinians arrested in Dubai in connection with the killing are former officers in the Palestinian security services, and were employed by a firm owned by a senior member of rival Fatah.

The London-based newspaper Al-Hayat reported that this company is owned by Mohammed Dahlan, formerly a Fatah strongman in the Gaza Strip before its takeover by Hamas two and a half years ago.

Bardawil also said that Mabhouh had put himself at risk by booking his trip through the Internet and risked a security breach by telling his family in Gaza by telephone which hotel he would be staying at.

Also Saturday, the daily newspaper Al-Bayan reported that Dubai police had new evidence implicating the Mossad in Mabhouh’s assassination, which included credit-card payments and suspects’ phone records.

“Dubai police have information confirming that the suspects purchased travel tickets from companies in other countries with credit cards carrying the same names we have publicized [from the passports],” Al-Bayan quoted Dubai police chief Tamim as saying.

Interpol has put 11 people suspected in the slaying of a Hamas militant leader in Dubai on its most-wanted list as Dubai police stepped up their accusations against Israel’s Mossad spy agency for the murder.

The international police agency said it has issued red notices, its highest-level alert, to its member countries worldwide for “11 internationally wanted individuals who have been charged by UAE-Dubai authorities with coordinating and committing the murder.”

Interpol says it was acting on the request of Dubai authorities and that it believes the suspects used false passports.

Interpol issued the notices – which include photographs – “to limit the ability of accused murderers from traveling freely using the same false passports.”

Hamas commander Mahmoud al-Mabhouh’s body was found Jan. 20 in his hotel room.

Meanwhile, Dubai Police Lt. Gen. Dahi Khalfan Tamim was quoted as saying he was “99 percent, if not 100 percent” certain that Mossad was behind last month’s slaying of al-Mabhouh in a luxury hotel room in Dubai.

Israel insists there is no evidence that Mossad agents were involved.

The comments – which appeared on the Web site of UAE daily The National – came as international pressure mounted for Israel to answer questions about possible links to the killing.

The investigation also widened to the United States. Emirates authorities said the alleged killers used fraudulent passports to open credit cards accounts through U.S.-based banks, an official said.

“Our investigations reveal that Mossad is involved in the murder of al-Mabhouh,” Tamim was quoted as saying by The National, which is owned by the government of Abu Dhabi.

He told another local paper, Dubai-based Gulf News, that: “All elements strongly indicate the involvement of the Mossad.”

Tamim and other Dubai police officials could not be immediately reached for further comment. Israel government spokesman Mark Regev also had no comment.

The international fallout from the murder in a Dubai hotel room showed no signs of easing, with Britain and Ireland summoning Israeli ambassadors Thursday for talks about the case following allegations that European passports were used by the alleged team of assassins.

A UAE official, who has close knowledge of the investigation, said at least 18 people – including two women – are now suspected in what Dubai police describe as a highly coordinated operation to kill al-Mabhouh, one of the founders of Hamas’ military wing.

Ten of the men and one woman were identified by Dubai police Monday as members of the group that traveled to Dubai on apparently fraudulent passports – six from Britain, three from Ireland and one each from Germany and France.

Britain has said it will investigate how some of the suspects came to have British passports – and how they might have been produced.

British Foreign Secretary David Miliband said one of the nation’s top diplomats, Peter Ricketts, “explained the concern we have for British passport holders in Israel” during the meeting with Israeli Ambassador Ron Prosor.

“He made clear that we wanted to give Israel every opportunity to share with us what it knows about this incident, and we hope and expect that they will cooperate fully with the investigation,” he said, adding he would raise the issue with Israel’s foreign minister when they meet in Brussels in the coming days.

Prosor told journalists he was not able to add additional information to Britain’s request.

Israel’s ambassador to Ireland, Zion Evrony, said he had nothing useful to tell Ireland because he knew nothing confidential about the Dubai assassination.

Irish Foreign Minister Micheal Martin has said the three Irish passports did have valid numbers but were issued to people with different names than those made public by Dubai.

He said the Foreign Ministry had contacted two people with the same passport numbers and found they had not lost their passports or had any stolen. The assassins apparently had access to pre-2005 passports that lacked biometric information, Martin said.

Also linked to the slaying are two Palestinians in Dubai custody and five others, including one woman who was caught on video surveillance at the luxury hotel where al-Mabhouh’s body was found Jan. 20, said the official, who spoke on condition of anonymity in line with standing policies.

Alleged Assassins Caught on Dubai Surveillance Tape

Dubai authorities have released extensive footage from surveillance cameras that allegedly shows the movements of a professional 11-person assassination team in the hours before and after a top Hamas leader was killed last month in a hotel room.

February 2 2010 Mahmoud al-Mabhouh, 49, a military official of the Islamic Resistance Movement, was found dead in his Dubai hotel room late last month. While the death appeared to be from natural causes, an autopsy revealed Mr. al-Mabhouh was killed, apparently by suffocation with a pillow after receiving electric shocks, perhaps from a taser.

Hamas has accused Israel of carrying out the killing, and Dubai police chief Dhahi Khalfan said that Mossad, Israel’s infamous spy and dirty tricks agency, was one suspect.

“I don’t exclude any party that has an interest in the assassination,” Mr. Khalfan said. “There were seven or more people holding passports from different European countries” in the group suspected of killing Mr. al-Mabhouh, he said.

This is not  a new phenomenon as this has been done many times, among other assassinations and terrorist acts by Israel.

Prime Minister Benjamin Netanyahu also  authorized the assassination of Khalid Mishal in 1997.

Mishal came to power largely as the result of a botched assassination attempt by seven Mossad agents in September 1997. Mossad used Canadian passports, some forged and some stolen from a Canadian embassy.

A press release issued by the department in Washington says that Dr Aafia, 37, faces a maximum sentence of 20 years in prison on each of the attempted murder and armed assault charges; life imprisonment on the firearm charge; and eight years in prison on each of the remaining assault charges. She also faces a mandatory minimum sentence of 30 years in prison on the firearm charge.

She is scheduled to be sentenced on May 6.

On Wednesday, a court in Manhattan, New York, found her guilty on charges related to the attempted murder and assault of US nationals and US officers and employees in Afghanistan.

She was found guilty of all charges against her following a 14-day jury trial before United States District Judge Richard M. Berman in the US District Court for the Southern District of New York.

In a case marked by controversy and courtroom disruptions, after three days of deliberation the jury rejected Dr Aafia’s claims that she did not attempt to shoot and kill American interrogators at an Afghan police compound on July 18, 2008.

“The family is trying to deal with this news, and they unfortunately have been subjected to a lot of bad news in the last six years,” Tina Foster, Dr Aafia’s family spokeswoman and a human rights lawyer for the New York-based International Justice Network, told reporters.

Her unknown whereabouts between 2003 and 2008 has been the subject of much debate among human rights organisations and US government officials. The government claims Dr Aafia was linked to Al Qaeda, while human rights organisations claim she was detained and tortured in US-backed secret prisons.

Prosecutors said she was taken into custody at an Afghan police station in the city of Ghazni on July 17, 2008, on suspicion of being a suicide bomber after Afghan officials caught her with paperwork mentioning ‘cells’ and a ‘mass casualty attack’. Source

Dr Siddiqui was convicted for the attempted killing of US agents while in detention in Afghanistan in 2008.

Jamaat-e-Islami’s women activists took out a rally outside Mansoora, party’s headquarters, on Multan Road to register their protest. Participants carrying placards raised slogans against US and Pakistani governments.

“This is a test case for the Ummah and (Muslim) rulers whether they show any reaction or not,” Jamaat chief Syed Munawar Hasan said in a statement.

“No body expected a different decision from the US especially in the presence of ‘insensible’ (Pakistani) rulers and the verdict is an American slap on their face.”

He asked Interior Minister Rehman Malik to prove his words that the nation would soon hear good news about Dr Siddiqui.

PTI: Pakistan Tehreek-e-Insaf Chairman Imran Khan demanded that the governments of Pakistan and the US clarify how Dr Siddiqui with her three minor children landed up in Bagram in Afghanistan. In a statement, he said what had been the fate of her children, since two of them were still missing.

He said the Pakistan government did not take proper action to ensure her return to Pakistan. He said the verdict would impact the military operation in the tribal belt.

LHCBA: A general house meeting of the Lahore High Court Bar Association (LHCBA) passed a resolution condemning the decision and “indifferent attitude of the Pakistani government” towards the case.

Lawyers demanded immediate release of Dr Siddiqui and her two children as, they said, allegations against her were baseless and she was a victim of American injustice against the Muslims.

LHCBA President Justice Nasira Iqbal (retired) said the partiality of the American judicial system was evident from the fact that during the trial no Muslim journalist was allowed to enter the court. She also condemned the murder of former NWFP advocate general Sardar Khan.

Supreme Court Bar Association Secretary Raja Zulqarnain also condemned the verdict, saying America that claimed to be the champion of human rights had turned to be the violator of human rights in the world.

Judicial Activism Panel Chairman Muhammad Azhar Siddique in a statement dubbed the decision “black and draconian”.

He said as no evidence supported the decision it violated the provisions of the United Nations Charter, 1945, Universal Declaration of Human Rights, 1948, International Covenant on Civil and Political Rights, 1966, World Conference on Human Rights, Vienna Declaration and Program of Action (1993).

He said the US jury had failed to notice the abduction of Dr Siddiqui from Karachi and her detention in Afghanistan and America, hence the decision was prejudice, biased, illegal and an attempt to save the American agencies involved in the abduction of the doctor.

Tehrik-e-Istiqlal President Rehmat Khan Wardag and Jamaatud Dawa amir Prof Muhammad Saeed also condemned the US jury.  Source

Not to sure about this, with the lack of evidence I have a hard time understanding how they found her guilty of anything. I certainly hope her lawyers goes for an appeal.

Still no verdict in Dr Aafia Siddiqui trial

On Tuesday, jurors in New York deliberated for a full day without reaching a verdict in the trial of Pakistani citizen Aafia Siddiqui, who is charged with attempted murder of FBI agents and US military personnel.

The deliberations are scheduled to resume on Wednesday.

Siddiqui is accused of grabbing a US warrant officer’s M-4 rifle in a police station in Ghazni, Afghanistan in July 2008 and firing two shots at FBI agents and military personnel when being interrogated for her alleged possession of documents detailing a ‘terrorist’ plan.

The prosecution says she burst from behind a curtain and attempted the ‘murder’ and was shot in the abdomen.

Last week, Siddiqui said she was concerned about being transferred to a “secret” prison by the US forces and was trying to slip out of the room when she was shot. “I’m telling you what I know. I walked toward the curtain. I was shot and I was shot again. I fainted,” she said.

Siddiqui’s lawyer Linda Moreno said during closing arguments Monday that the “science” supported her testimony that she didn’t touch the weapon or fire it.

“Where are the bullet holes? …Did the Afghanis take the bullet holes? …There is no physical evidence that an M-4 rifle was touched by Dr. Aafia Siddiqui, let alone fired,”The Wall Street Journal quoted Moreno as saying.

Siddiqui vanished in Karachi, Pakistan with her three children on March 30, 2003. The next day it was reported in local newspapers that she had been taken into custody on terrorism charges.

US officials allege that she was seized on July 17, 2008 by Afghan security forces in Ghazni province and claim that documents, including formulas for explosives and chemical weapons, were found in her handbag.

She has been brought to the United States to face charges of attempted murder and assault. Siddiqui faces 20 years in prison on the attempted murder charges and life in prison on the firearms charge.

However, human rights organizations have cast doubt on the accuracy of the US account of the event.

Many political activists believe she was Prisoner 650 of the US detention facility in Bagram, Afghanistan, where they say she was tortured for five years until one day US authorities announced that they had found her in Afghanistan.
