Dear Members of Congress,

We write to express our concern about recent reports published in the Guardian and the Washington Post, and acknowledged by the Obama Administration, which reveal secret spying by the National Security Agency (NSA) on phone records and Internet activity of people in the United States.

The Washington Post and the Guardian recently published reports based on information provided by an intelligence contractor showing how the NSA and the FBI are gaining broad access to data collected by nine of the leading U.S. Internet companies and sharing this information with foreign governments. As reported, the U.S. government is extracting audio, video, photographs, e-mails, documents, and connection logs that enable analysts to track a person’s movements and contacts over time. As a result, the contents of communications of people both abroad and in the U.S. can be swept in without any suspicion of crime or association with a terrorist organization.

Leaked reports also published by the Guardian and confirmed by the Administration reveal that the NSA is also abusing a controversial section of the PATRIOT Act to collect the call records of millions of Verizon customers. The data collected by the NSA includes every call made, the time of the call, the duration of the call, and other “identifying information” for millions of Verizon customers, including entirely domestic calls, regardless of whether those customers have ever been suspected of a crime. The Wall Street Journal has reported that other major carriers, including AT&T and Sprint, are subject to similar secret orders.

This type of blanket data collection by the government strikes at bedrock American values of freedom and privacy. This dragnet surveillance violates the First and Fourth Amendments of the U.S. Constitution, which protect citizens’ right to speak and associate anonymously, guard against unreasonable searches and seizures, and protect their right to privacy.

We are calling on Congress to take immediate action to halt this surveillance and provide a full public accounting of the NSA’s and the FBI’s data collection programs. We call on Congress to immediately and publicly:

  1. Enact reform this Congress to Section 215 of the USA PATRIOT Act, the state secrets privilege, and the FISA Amendments Act to make clear that blanket surveillance of the Internet activity and phone records of any person residing in the U.S. is prohibited by law and that violations can be reviewed in adversarial proceedings before a public court;
  2. Create a special committee to investigate, report, and reveal to the public the extent of this domestic spying. This committee should create specific recommendations for legal and regulatory reform to end unconstitutional surveillance;
  3. Hold accountable those public officials who are found to be responsible for this unconstitutional surveillance.

Clapper lied to Congress

March 12, 2013- Senator Ron Wyden (D-Ore.) asks questions in Senate Intelligence Committee on warrantless geolocation surveillance and National Security Agency tracking.

At the end of this video James Clapper states, they do not collect information/data on millions of Americans. That of course is blatant lie, as we now know. Making a statement as such, under oath is a crime.

If you lie to Congress, it is a felony and you can/should go to prison for it.

On March 12 when Sen Ron Wyden questioned Director of National Intelligence James Clapper, who was testifying in the Senate under oath, the senator, like any good lawyer, knew exactly what he was asking and chose his words carefully.

“Does the NSA collect any type of data at all on millions or hundreds of millions of Americans?” Wyden asked. He didn’t ask whether the NSA is reading our emails or listening to our phone calls. He used the all-inclusive “any type of data at all” and he was questioning the chief intelligence officer of the United States — and man who is perfectly aware of the breadth and nuance that attaches to the term “data.” Clapper doesn’t need a staff member to tutor him on the meaning of metadata — that is, to explain that this too is a form of data.

In a letter to Senate Intelligence Committee Chairwoman Dianne Feinstein, Clapper now claims that when he denied the NSA is collecting data on million of Americans, “my answer focused on the collection of the content of communications.”

He could have said: “I gave an answer to a question I hadn’t been asked.”

He now says: “My response was clearly erroneous — for which I apologize.”

To call it erroneous is to imply that he made a mistake rather than that he was intentionally deceptive. That admission would be a confession to breaking the law. At this point, Clapper seems to think he can brush aside accusations that he committed perjury.

Several senators are clearly unimpressed by Clapper’s explanation.

“It now appears clear that the director of national intelligence, James Clapper, lied under oath to Congress and the American people,” Rep. Justin Amash (R-Mich.) tweeted.

“Perjury is a serious crime … [and] Clapper should resign immediately,” he said.

Sen. Rand Paul (R-Ky.) said that Clapper had broken the law, comparing him to NSA leaker Edward Snowden, who has been charged with espionage.

“Mr. Clapper lied in Congress in defiance of the law in the name of security,” Paul said on CNN last month. “Mr. Snowden told the truth in the name of privacy. So, I think there will be a judgment, because both of them broke the law, and history will have to determine.”

Wyden, who knew about the NSA programs when he pressed Clapper on them, said that Clapper was preventing Congress from conducting oversight.

“This job cannot be done responsibly if Senators aren’t getting straight answers to direct questions,” Wyden said in a statement last month.

He also attempted to come up with and excuse as to why no Weapons of Mass Destruction were found in Iraq.

THE STRUGGLE FOR IRAQ: WEAPONS SEARCH; Iraqis Removed Arms Material, U.S. Aide Says

The director of a top American spy agency said Tuesday that he believed that material from Iraq’s illicit weapons program had been transported into Syria and perhaps other countries as part of an effort by the Iraqis to disperse and destroy evidence immediately before the recent war.

The official, James R. Clapper Jr., a retired lieutenant general, said satellite imagery showing a heavy flow of traffic from Iraq into Syria, just before the American invasion in March, led him to believe that illicit weapons material ”unquestionably” had been moved out of Iraq.

”I think people below the Saddam Hussein-and-his-sons level saw what was coming and decided the best thing to do was to destroy and disperse,” General Clapper, who leads the National Imagery and Mapping Agency, said at a breakfast with reporters.

He said he was providing a personal assessment. But he said ”the obvious conclusion one draws” was that there ”may have been people leaving the scene, fleeing Iraq, and unquestionably, I am sure, material.” A spokesman for General Clapper’s agency, David Burpee, said he could not provide further evidence to support the general’s statement.

But other American intelligence officials said General Clapper’s theory was among those being pursued in Iraq by David Kay, a former United Nations weapons inspector who is leading the American effort to uncover the weapons cited by the Bush administration as the major reason for going to war against Iraq.

General Clapper’s comments came as the Central Intelligence Agency prepared to defend its prewar assertions that Iraq had chemical and biological weapons and that it sought to reconstitute its nuclear program. The director of central intelligence, George J. Tenet, has written a letter to the chairman and vice chairman of the Senate Select Committee on Intelligence saying the agency will be ready to provide an assessment by late November.

In the letter, the contents of which were described by several intelligence officials on Tuesday, Mr. Tenet proposed that a team headed by John McLaughlin, the deputy director of central intelligence, provide a briefing for the committee after Nov. 20, when the agency’s internal review is expected to be completed.

General Clapper’s agency is responsible for interpreting satellite photographs and other imagery. He declined to answer a question about whether he believed that illicit Iraqi weapons material might have been smuggled into any other country. Source

It’s been a few hundred years since the Third Amendment was written to keep King George from quartering British troops in American homes, but a lawsuit just filed in Nevada suggests it’s as relevant as ever.

The framers of the Constitution ratified the Third Amendment to ensure citizens would never again have to accommodate soldiers, but a few centuries later it’s become more-or-less an antiquated law that’s rarely referenced in federal court. That changed recently when a family from Henderson, Nevada accused the local police department of constitutional violations after officers of the law allegedly took residence in two neighborhood homes.

According to a legal filing first obtained by Courthouse News Service, a handful of Henderson Police Department officers and the city itself are being sued for an array of charges — including Third Amendment violations — over an incident that mirrors the making of the American Revolution.

Attorneys for the plaintiffs say police officers demanded they be allowed to occupy two homes owned by their clients on the city’s Eveningside Avenue in 2011 in order to conduct an investigation involving a neighbor’s residence. When the owners refused to comply with the request, they were reportedly arrested for obstruction and brought to jail.

Police were investigating an incident at 363 Eveningside Avenue that July when Officer Christopher Worley called up the occupant of a neighboring property, Anthony Mitchell, and said he’d need to use his house in order to gain a ‘tactical advantage’ over the neighbor’s residence. Mitchell reportedly made it clear that he did not want to get involved in the probe and told Worley he would not be able to offer assistance. According to the lawsuit, Officer David Cawthorn, Sgt. Michael Waller and Worley all then “conspired among themselves to force Anthony Mitchell out of his residence and to occupy his home for their own use.”

It was determined to move to 367 Eveningside and attempt to contact Mitchell. If Mitchell answered the door he would be asked to leave. If he refused to leave he would be arrested for Obstructing a Police Officer. If Mitchell refused to answer the door, force entry would be made and Mitchell would be arrested,” the report determined.

Moments later, the officers “arrayed themselves in front of plaintiff Anthony Mitchell’s house and prepared to execute their plan,” after which they “loudly commanded” they be let inside. Seconds later, Mitchell’s door was knocked down with a metal battering ram and the police entered his home.

As plaintiff Anthony Mitchell stood in shock, the officers aimed their weapons at Anthony Mitchell and shouted obscenities at him and ordered him to lie down on the floor,” the suit alleges.

As the police moved into the home, Mitchell was reportedly called an “asshole” by the cops, ordered to crawl on the floor and then shot several times with non-lethal ‘pepperball rounds’ from close range. He was then arrested for obstructing an officer while the cops combed through his house without permission, but not before they also opened fire at the plaintiff’s dog, prompting it to howl “in fear and pain.”

At the same time, officers approached Anthony’s parents down the block at 362 Eveningside and asked father Michael Mitchell if he’d accompany them back to a local ‘command center’ to assist with negotiating the surrender of the neighbor suspected of domestic violence. When he got there, though, he became concerned that the cops had tricked him into leaving so they could try to gain access to yet another home. Michael Mitchell then tried to head back home, but when he left the command center he was arrested, handcuffed and placed in the back of a cop car.

Attorney for the family say there was no reasonable grounds to detain Michael Mitchell, nor probable cause to suspect him of committing any crime. That didn’t keep officers from holding both him and his son Anthony for nine hours, however, before they were ultimately released after posting bond.

All criminal counts against the Mitchells were later dismissed with prejudiced, but the family has now lobbed charges of their own. Their attorney is asking for a trial by jury to hear the case and ideally award his clients punitive damages for violations of the Third, Fourth and Fourteenth Amendments, assault and battery, conspiracy, defamation, abuse of process, malicious prosecution, negligence and emotional distress. Conflicting reports have emerged out of Pakistan that the alleged American born al Qaeda Member Adam Gadahn has been arrested. What needs to be explained should it actually turn out to be Gadahn, is that he’s already been exposed as an Israeli-Zionist agent through the ADL.

As reported by CBS:

CBS News was told by sources in the Pakistan government that it was Gadahn, even after U.S. officials refused to confirm it was the California native for whom a $1 million reward has been posted.

Later, CBS News’ Farhan Bokhari in Islamabad reported that earlier reports the detained individual was Gadahn proved false. According to a Pakistan security official who spoke with CBS News on condition of anonymity, the arrested individual is in fact “a Taliban militant leader who is known as Abu Yahya.”

The article then continues to reaffirm the deception that Gadahn is a real al Qaeda terrorist, and that the arrest is a severe blow to the terrorists.

Israel yesterday threatened to launch a second military offensive in Gaza, just hours after its jets and helicopters pounded the coastal enclave in response to the firing of a Qassam rocket by militants in the strip.

The Israeli military said it had successfully hit four targets across Gaza in the early hours of yesterday morning – two weapons-manufacturing plants and two arms caches.

Eyewitnesses in Gaza said there were at least seven strikes, and a cheese factory, a film studio and metal workshop in the central refugee camp of Nuseirat had been hit. Hospital officials said three Palestinian children had been injured after being hit by flying debris.

The Qassam rocket, which prompted the aerial strikes, was fired from Gaza into Israel on Thursday. It caused no damage and no Palestinian faction has claimed responsibility.

“If this rocket fire against Israel does not stop, it seems we will have to raise the level of our activity and step up our actions against Hamas,” Silvan Shalom, Israel’s Deputy Prime Minister, told public radio.”We won’t allow frightened children to again be raised in bomb shelters and so, in the end, it will force us to launch another military operation.”

Yesterday’s Israeli aerial strikes mark the Prime Minister Benjamin Netanyahu’s most significant military incursion in Gaza since the devastating offensive in December 2008, which lasted 22 days and killed 1,400 Palestinians, mainly civilians, and 13 Israelis.

In recent weeks, tensions have ratcheted up, ending months of relative calm. Two Israeli soldiers and two Palestinian fighters were killed last week in a fierce border skirmish after Israelis crossed into the strip.

Britain’s Foreign Office last night called for restraint. “We are concerned by today’s strikes and the escalation of violence in Gaza and southern Israel over the past week,” it said in a statement. “We encourage Israelis and Palestinians to focus efforts on negotiation and to engage urgently in US-backed proximity talks.”

According to the Israeli tally, 20 rockets and mortars were fired from Gaza last month, and 40 since the beginning of the year. While Islamist groups largely hostile to Hamas have claimed responsibility for previous rocket attacks, Israel insists that ultimate responsibility lies with Hamas, which has controlled the strip since 2007.

Hamas yesterday accused Israel of stoking tensions with its “escalation” of military activity. But it also said it was “making contact with the factions to safeguard internal agreement” – an apparent effort to bring Islamist groups into line.

Khaled Meshaal, the Hamas leader exiled in Damascus, said earlier in the week that it was not in the Islamist group’s interests to escalate tensions, and that it would maintain the calm, but it has been careful not to openly condemn rocket attacks on Israel.

The latest tensions come as Israel is embroiled in a deepening row with its closest ally, the United States, over an ill-timed decision to build 1,600 new settlement homes in East Jerusalem.

The US is now seeking far-reaching concessions from Israel, including the easing of the Israeli blockade on Gaza, to show it is serious about negotiating a peace deal with the Palestinians. Israel is not expected to provide a formal response until after the end of the Jewish Passover holiday.

Israeli planes and helicopters mount Gaza attacks

Israeli planes and helicopters mounted at least seven missile attacks on the Hamas-ruled Gaza Strip today, destroying what a military spokesman described as Palestinian munitions sites.

Four air strikes blew up two caravans near the town of Khan Younis, witnesses and Hamas officials said. There were no casualties in this attack.

A fifth missile hit a cheese factory in Gaza City, setting it on fire, the witnesses and Hamas officials said. Hospital officials said two children were slightly wounded by flying debris.

Helicopters struck twice in the central refugee camp of Nusseirat, destroying a metal foundry and no one was injured.

An Israeli military spokesman confirmed the attacks, saying they had targeted two weapons-manufacturing plants and two arms caches.

The air strikes were Israel’s response to a Palestinian short-range rocket that was fired across the border into the Jewish state on Thursday, the spokesman said. The attack, which went unclaimed by any Palestinian faction, caused no damage.

Israel has said it will hold Hamas responsible for any attacks on its cities from the Gaza Strip.

Hamas’s leader in Gaza, Ismail Haniyeh, said the Islamist group was trying to reaffirm an agreement reached last year with other Palestinian factions to curb the rocket fire.

An Israeli offensive in the Gaza Strip early last year was designed to counter such salvoes. Rocket attacks have resumed sporadically in recent weeks and Israel has responded with air strikes. Source

Auh yes the old rockets into Israel ploy again. Well I really have to wonder if Israel isn’t arranging these rockets themselves. The do false Flags a lot.

Israel has been bombing Gaza for some time this again is not new.

They always have of course some feeble excuse or other. They just want to kill and torment those in Gaza.

They do everything imaginable to torment them.

I for one really don’t believe the rocket story any more.

If Israel ever told the truth about anything well maybe one could believe it but they lie continually about everything. For them any old excuse works, with no oversight to what they actually do.

Auh yes  Israel is yet again playing the victim card.

They just want to blow up what is left of Gaza.

They want to kill more innocent people. That is what they love to do most.

Maybe Israel should stop stealing land  for illegal settlements and stop assassinating people.

Israel has been getting away with murder and theft for over 60 years.

Bethlehem – Ma’an – Israel’s Army Radio reported Friday that Ashkelon police have not been able to locate the remnants of a projectile they said was fired from Gaza after the area’s Color Red siren was sounded.

The Israeli news site Ynet said investigators announced the projectile was a “Qassam rocket … launched from the Gaza Strip.”

There were no reports of damage or injury.

The launch followed an overnight Israeli airstrike that injured three children when missiles struck a dairy factory in the north of the Gaza Strip. A second factory and police headquarters were also targeted, witnesses said.

Medics said debris from the strikes damaged buildings, and flying shrapnel caused moderate injuries to three children aged one, four, and 11. Source

The Al Deira Hotel, in Gaza City, is a haven of calm in a land beset by poverty, fear, and violence. In the middle of December 2007, I sit in the hotel’s airy restaurant, its windows open to the Mediterranean, and listen to a slight, bearded man named Mazen Asad abu Dan describe the suffering he endured 11 months before at the hands of his fellow Palestinians. Abu Dan, 28, is a member of Hamas, the Iranian-backed Islamist organization that has been designated a terrorist group by the United States, but I have a good reason for taking him at his word: I’ve seen the video.

It shows abu Dan kneeling, his hands bound behind his back, and screaming as his captors pummel him with a black iron rod. “I lost all the skin on my back from the beatings,” he says. “Instead of medicine, they poured perfume on my wounds. It felt as if they had taken a sword to my injuries.”

On January 26, 2007, abu Dan, a student at the Islamic University of Gaza, had gone to a local cemetery with his father and five others to erect a headstone for his grandmother. When they arrived, however, they found themselves surrounded by 30 armed men from Hamas’s rival, Fatah, the party of Palestinian president Mahmoud Abbas. “They took us to a house in north Gaza,” abu Dan says. “They covered our eyes and took us to a room on the sixth floor.”

The video reveals a bare room with white walls and a black-and-white tiled floor, where abu Dan’s father is forced to sit and listen to his son’s shrieks of pain. Afterward, abu Dan says, he and two of the others were driven to a market square. “They told us they were going to kill us. They made us sit on the ground.” He rolls up the legs of his trousers to display the circular scars that are evidence of what happened next: “They shot our knees and feet—five bullets each. I spent four months in a wheelchair.”

Abu Dan had no way of knowing it, but his tormentors had a secret ally: the administration of President George W. Bush.

A clue comes toward the end of the video, which was found in a Fatah security building by Hamas fighters last June. Still bound and blindfolded, the prisoners are made to echo a rhythmic chant yelled by one of their captors: “By blood, by soul, we sacrifice ourselves for Muhammad Dahlan! Long live Muhammad Dahlan!”

There is no one more hated among Hamas members than Muhammad Dahlan, long Fatah’s resident strongman in Gaza. Dahlan, who most recently served as Abbas’s national-security adviser, has spent more than a decade battling Hamas. Dahlan insists that abu Dan was tortured without his knowledge, but the video is proof that his followers’ methods can be brutal.

Bush has met Dahlan on at least three occasions. After talks at the White House in July 2003, Bush publicly praised Dahlan as “a good, solid leader.” In private, say multiple Israeli and American officials, the U.S. president described him as “our guy.”

The United States has been involved in the affairs of the Palestinian territories since the Six-Day War of 1967, when Israel captured Gaza from Egypt and the West Bank from Jordan. With the 1993 Oslo accords, the territories acquired limited autonomy, under a president, who has executive powers, and an elected parliament. Israel retains a large military presence in the West Bank, but it withdrew from Gaza in 2005.

In recent months, President Bush has repeatedly stated that the last great ambition of his presidency is to broker a deal that would create a viable Palestinian state and bring peace to the Holy Land. “People say, ‘Do you think it’s possible, during your presidency?’ ” he told an audience in Jerusalem on January 9. “And the answer is: I’m very hopeful.”

The next day, in the West Bank capital of Ramallah, Bush acknowledged that there was a rather large obstacle standing in the way of this goal: Hamas’s complete control of Gaza, home to some 1.5 million Palestinians, where it seized power in a bloody coup d’état in June 2007. Almost every day, militants fire rockets from Gaza into neighboring Israeli towns, and President Abbas is powerless to stop them. His authority is limited to the West Bank.

It’s “a tough situation,” Bush admitted. “I don’t know whether you can solve it in a year or not.” What Bush neglected to mention was his own role in creating this mess.

According to Dahlan, it was Bush who had pushed legislative elections in the Palestinian territories in January 2006, despite warnings that Fatah was not ready. After Hamas—whose 1988 charter committed it to the goal of driving Israel into the sea—won control of the parliament, Bush made another, deadlier miscalculation.

Vanity Fair has obtained confidential documents, since corroborated by sources in the U.S. and Palestine, which lay bare a covert initiative, approved by Bush and implemented by Secretary of State Condoleezza Rice and Deputy National Security Adviser Elliott Abrams, to provoke a Palestinian civil war. The plan was for forces led by Dahlan, and armed with new weapons supplied at America’s behest, to give Fatah the muscle it needed to remove the democratically elected Hamas-led government from power. (The State Department declined to comment.)

But the secret plan backfired, resulting in a further setback for American foreign policy under Bush. Instead of driving its enemies out of power, the U.S.-backed Fatah fighters inadvertently provoked Hamas to seize total control of Gaza.

Some sources call the scheme “Iran-contra 2.0,” recalling that Abrams was convicted (and later pardoned) for withholding information from Congress during the original Iran-contra scandal under President Reagan. There are echoes of other past misadventures as well: the C.I.A.’s 1953 ouster of an elected prime minister in Iran, which set the stage for the 1979 Islamic revolution there; the aborted 1961 Bay of Pigs invasion, which gave Fidel Castro an excuse to solidify his hold on Cuba; and the contemporary tragedy in Iraq.

Within the Bush administration, the Palestinian policy set off a furious debate. One of its critics is David Wurmser, the avowed neoconservative, who resigned as Vice President Dick Cheney’s chief Middle East adviser in July 2007, a month after the Gaza coup.

Wurmser accuses the Bush administration of “engaging in a dirty war in an effort to provide a corrupt dictatorship [led by Abbas] with victory.” He believes that Hamas had no intention of taking Gaza until Fatah forced its hand. “It looks to me that what happened wasn’t so much a coup by Hamas but an attempted coup by Fatah that was pre-empted before it could happen,” Wurmser says.

The botched plan has rendered the dream of Middle East peace more remote than ever, but what really galls neocons such as Wurmser is the hypocrisy it exposed. “There is a stunning disconnect between the president’s call for Middle East democracy and this policy,” he says. “It directly contradicts it.”

Preventive Security

Bush was not the first American president to form a relationship with Muhammad Dahlan. “Yes, I was close to Bill Clinton,” Dahlan says. “I met Clinton many times with [the late Palestinian leader Yasser] Arafat.” In the wake of the 1993 Oslo accords, Clinton sponsored a series of diplomatic meetings aimed at reaching a permanent Middle East peace, and Dahlan became the Palestinians’ negotiator on security.

As I talk to Dahlan in a five-star Cairo hotel, it’s easy to see the qualities that might make him attractive to American presidents. His appearance is immaculate, his English is serviceable, and his manner is charming and forthright. Had he been born into privilege, these qualities might not mean much. But Dahlan was born—on September 29, 1961—in the teeming squalor of Gaza’s Khan Younis refugee camp, and his education came mostly from the street. In 1981 he helped found Fatah’s youth movement, and he later played a leading role in the first intifada—the five-year revolt that began in 1987 against the Israeli occupation. In all, Dahlan says, he spent five years in Israeli jails. Source

So Fatah members could very easily launch the rockets and Israel of course as usual Blames Hamas. What a tidy set up. This also gave Israel reason, a fabricated reason to attack Gaza and kill more innocent people.

Israel probably set it up. When Israel wants an excuse to attack Gaza it creates one. Just a point of interest. Fatah and Israel have  access to weapons, where as those in Gaza do not. Who would let weapons into Gaza at the checkpoints . Israel of course. So if Israel wants to create a problem Israel certainly could very easily. Would they, well of course they would.

It is easier for Israel to smuggle rockets into  Gaza then it is for Hamas.

After all they still want the Natural Gas of the Shores of Gaza now don’t they?

UN official: Enough evidence to prosecute Rumsfeld for war crimes

Monday, the United Nations Special Rapporteur on Torture, Manfred Nowak told CNN’s Rick Sanchez that the US has an “obligation” to investigate whether Bush administration officials ordered torture, adding that he believes that there is already enough evidence to prosecute former Secretary of Defense Donald Rumsfeld.

“We have clear evidence,” he said. “In our report that we sent to the United Nations, we made it clear that former Defense Secretary Donald Rumsfeld clearly authorized torture methods and he was told at that time by Alberto Mora, the legal council of the Navy, ‘Mr. Secretary, what you are actual ordering here amounts to torture.’ So, there we have the clear evidence that Mr. Rumsfeld knew what he was doing but, nevertheless, he ordered torture.”

Asked during an interview with Germany’s ZDF television on Jan. 20, Nowak said: “I think the evidence is on the table.”

At issue, however, is whether “American law will recognize these forms of torture.”

A bipartisan Senate report released last month found Rumsfeld and other top administration officials responsible for abuse of Guantanamo detainees in US custody.

It said Rumsfeld authorized harsh interrogation techniques on December 2, 2002 at the Guantanamo prison, although he ruled them out a month later.

The coercive measures were based on a document signed by Bush in February, 2002.

UK ‘must release’ Iraq war files

The British government has been ordered to release the minutes of crucial ministerial meetings from 2003 at which the United States-led invasion of Iraq was discussed.

The information tribunal, which hears appeals under Britain’s data protection act, backed a decision to disclose minutes of cabinet meetings from March 13 and 17, where ministers held talks about whether the decision to go to war was allowed under international law.

The tribunal said: “We have decided that the public interest in maintaining the confidentiality of the formal minutes of two cabinet meetings at which ministers decided to commit forces to military action in Iraq did not… outweigh the public interest in disclosure.

The cabinet office has 28 days to decide whether to appeal against the ruling.

Announcing its decision on Tuesday, the tribunal said: “The decision to commit the nation’s armed forces to the invasion of another country is momentous in its own right, and… its seriousness is increased by the criticisms that have been made  of the general decision-making processes in the cabinet at the time.”

A spokesman for Gordon Brown, the British prime minister, said: “We are considering our response”.

Blair criticised

Tony Blair, prime minister at the time of the invasion, was widely criticised for backing George Bush, the then US president, in invading Iraq to oust Saddam Hussein despite failing to secure a second United Nations resolution on the matter.

Ministerial discussions focused notably on Peter Goldsmith’s, the then attorney general, advice on the legality of war.

Blair’s government strongly resisted demands for the advice of its most senior legal adviser to be made public, until a large section was leaked during the 2005 general election campaign.

Goldsmith then denied ministers pressured him into changing his mind to rule that invading Iraq would be legal in international law even without a second UN security council resolution.

The information tribunal said that “there has… been criticism of the attorney general’s legal advice and of the particular way in which the March 17 opinion was made available to the cabinet only at the last moment and the March 7 opinion was not disclosed to it at all.”

The tribunal ruling backed up an earlier decision by Richard Thomas, the information commissioner.

Thomas said: “I am pleased that the tribunal has upheld my decision that the public interest in disclosing the official cabinet minutes in this particular case outweighs the public interest in withholding the information.

“Disclosing the minutes will allow the public to more fully understand this particular decision.”

Blair and his cohorts  should be tried for war crimes as well.

Others in the Bush Administration as well as Bush, should also be charged with war crimes and crimes against Humanity.

The weapons alone that were used, are one good place to start.

The war was based on fabricated information and lies.

Torture was condoned. Killing over a million people is Genocide.

Also there are the deaths an injuries suffered by the soldiers who were sent to the illegal war.

The list of crimes is quite extensive.

There is also the abuse of power. I would even call it treason.

No one should ever again, be allowed to commit these types of crimes and those who did, certainly should not go free. They are criminals.

Shoe Bush? JANUARY 19th

Why Shoe Bush?

Our president stood in a nation he had illegally invaded and occupied, where his actions had caused over 1.2 million deaths, 5 million people forced out of their homes, millions more deprived of electricity or clean water and afraid to walk the streets. He stood smiling in a nation he had transformed into a living hell, a place where everyone had seen loved ones and neighbors killed. And when Muntadar Al-Zeidi threw two shoes at him, our president remarked “I don’t know what his beef is.”

But billions of people around the world believed that the pretended obliviousness of George W. Bush to the pain and suffering he was inflicting had gone on as long as they could stand if not much longer, and Al-Zeidi became a hero overnight. His two shoes punctured the Bush veil of separation, the distance Bush pretends to imagine exists between his decisions and the human limbs scattered in the sand of his colony. And while the U.S. media pretended to wonder whether the water torture was “really” torture, the United States and its puppet government in Iraq inflicted on Al-Zeidi one of the more commonly employed torture techniques of the Bush regime: they beat him and broke his bones.

In an ideal world, it would be enough to present the evidence of crimes for Bush, Cheney, and their criminal subordinates to be prosecuted and convicted. In this world, we’ve presented that evidence for years, and we are still in a climate in which Bush and Cheney blissfully admit their crimes, apparently believing that they render prosecution less likely by declaring their own crimes acceptable. While lies may take hold more easily the bigger they are, big lies also collapse quickly, as when a child points to a naked emperor, or a journalist throws his shoes.

We have a president-elect who can save himself from engaging in criminal wars and occupations, in torture and other war crimes, in warrantless spying and other violations of our Constitution, only by prosecuting the actions of his predecessor. Not to prosecute is itself a crime. If we are going to persuade the president elect, we must first persuade the U.S. media, and the U.S. media is not attracted by facts and information. The U.S. media is attracted by throwing shoes.

Bush’s last act is expected to be the unprecedented pardoning of crimes he authorized. This has never before been done, and to do so is to drop all claim to being a nation of laws. Thanks to the example set by Al-Zeidi, since emulated by people all over the world, we will know exactly how to make our response visible when those pardons come.

We will be acting in the spirit of Mutadhar Al-Zaidi, the journalist who threw his shoes at Bush during a press conference on behalf of the widows, orphans and all those killed in Iraq, and in solidarity with the Iraqi people as well as all of those who have suffered under the Bush regime.

To watch Bush leave office and not be held accountable for war crimes and impeachable offenses is like rubbing salt into the wound.

This action may not take away all of the pain suffered during the Bush regime but we will get satisfaction from the statement the act makes. The shoe hurling will be a historic marker. The visual of thousands of people hurling shoes at the White House as Bush leaves office will go around the globe and the people all over the world will let out a collective cheer. Please join us in being part of history!

U.S. acknowledges it held 12 juveniles at Guantanamo Bay prison

SAN JUAN, Puerto Rico – The U.S. has revised its count of juveniles ever held at Guantanamo Bay to 12, up from the eight it reported in May to the United Nations, a Pentagon spokesman said Sunday.

The government has provided a corrected report to the UN committee on child rights, according to navy Cmdr. Jeffrey Gordon. He said the U.S. did not intentionally misrepresent the number of detainees taken to the isolated base in southeast Cuba before turning 18.

“As we noted to the committee, it remains uncertain the exact age of many of the juveniles held at Guantanamo, as most of them did not know their own date of birth or even the year in which they were born,” he said.

A study released last week by the Center for the Study of Human Rights in the Americas concluded the U.S. has held at least a dozen juveniles at Guantanamo, including a Saudi who committed suicide in 2006.

“The information I got was from their own sources, so they didn’t have to look beyond their own sources to figure this out,” said Almerindo Ojeda, director of the centre at the University of California, Davis.

Rights groups say it is important for the U.S. military to know the real age of those it detains because juveniles are entitled to special protection under international laws recognized by the United States.

Eight of the 12 juvenile detainees identified by the human rights centre have been released, according to the study.

Two of the remaining detainees are scheduled to face war-crimes trials in January.

Canadian Omar Khadr, now 21, was captured in July 2002 and is charged with murder for allegedly throwing a grenade that killed a U.S. special forces soldier. Mohammed Jawad, an Afghan who is about 24, faces attempted murder charges for a 2002 grenade attack that wounded two U.S. soldiers.

The study identified the only other remaining juvenile as Muhammed Hamid al Qarani of Chad.

The Saudi who hanged himself with two other detainees in 2006, Yasser Talal al-Zahrani, was 17 when he arrived at Guantanamo within days of the military prison opening in January 2002, according to the study.

About 250 prisoners remain at Guantanamo on suspicion of terrorism or links to al-Qaida or the Taliban.

Guantánamo’s Children: Military and Diplomatic Testimonies

every human being below the age of eighteen years unless
under the law applicable to the child,  majority  is attained

On April 25, 2003, Secretary of State Donald Rumsfeld and Chairman of the Joint Chiefs of Staff General Richard Myers held a news briefing at the Pentagon. At that briefing, Secretary Rumsfeld was asked about the juveniles in Guantanamo. Rumsfeld took the opportunity to complain about “this constant refrain of the juveniles, as though there’s a hundred of children in there”. Secretary Rumsfeld’s complaint raises a very good question. Exactly how many children have been seized and taken to Guantánamo?

1. Eleven Children Recognized by the Department of Defense

Two documents released by the U.S. Department of Defense identify 11 Guantánamo prisoners that were under the age of 18 at the time they were seized. These documents are:

  • List of individuals Detained by the Department of Defense at Guantanamo Bay, Cuba from January 2002 through May 15, 2006
  • Measurements of Heights and Weights of Individuals Detained by the Department ofon March 16, 2007.

The first of these documents provides dates of birth for these prisoners; the second presents in-processing dates for many of them. The following table summarizes the information gathered from these two sources. Here DD and MMM stand, respectively, for day and month unknown.1

The fact that two of these prisoners were seized as children was also acknowledged by the State Department. Indeed, in its response to a question from the United Nations Committee on the Rights of the Child, the State Department stated that

“Mr. [Omar] Khadr and Mr. [Mohamed] Jawad are currently the only two individuals captured under the age of 18 that the U.S. Government has chosen to prosecute under the Military Commissions Act of 2006 (See United States Written Response to Questions Posed by the Committee on the Rights of the Child, Answer to Question 12(c)).”

Also consistent with these claims are the results of a bone scan analysis cited at Mr. Jawad’s trial by military commission.  In-processed in Afghanistan on December 18, 2002, Mohamed Jawad was subsequently transferred to Guantánamo on or about February 6, 2003 . 2. Mohammed Ismail: A Twelfth Child Recognized by Military Officials

On February 2003, Lt. Col. Larry C. James, chief Guantánamo psychologist, flew to Afghanistan to bring three boys to the base. There they were held in Camp Iguana, a facility built especially for them in order to segregate them from the adult population of the prison (Fixing Hell, pp. 34-49). According to Captain James Yee, the Muslim chaplain who tended to the religious instruction of the Camp Iguana inmates, their first names were Assadulah, Naqibullah, and Ismail (For God and Country, pp. 93-96).2

The three boys remained in Guantánamo “for about a year” . Then, on January 29, 2004, the Department of Defense announced that three children had been released from Guantánamo, where they were “housed in a separate facility modified to meet the special needs of juveniles” .

On February 7, 2004 the Guardian published an article identifying these children as Assad Ullah, Naqib Ullah, and Mohammed Ismail. The first two of these children are included in the table in Section 1; the third one is not. Consequently, we can identify a twelfth Guantánamo prisoner that was captured as a minor. He is Mohammed Ismail.

Independent confirmation for this identification is provided by the fact that both Mohammed Ismail and Naqib Ullah were in-processed on 07 FEB 03 (both Lt. Col. James and Capt. Yee write that Naqib Ullah and Ismail arrived on the same day).

If Mohammed Ismail was seized as a juvenile in 2003, then he could not have been born in 1984, as the Departement of Defense claims in its 2006 list of prisoners; Mohammed Ismail must have been born later.

In its January 29, 2004 announcement of the release of the children, the Department of Defense indicated that medical tests performed after they were seized determined that “all three juveniles were under the age of 16″. Consequently, the date of birth for Mohammed Ismail given in the DoD list of prisoners must be amended to read “after 07 FEB 87”, which would be the date of his 16th birthday.

3. How Many Children Have Been Seized and Taken to Guantánamo?

On May 13, 2008, the U.S. State Department answered in writing, through its Bureau of Democracy Human Rights and Labor, a questionnaire from the United Nations Committee on the Rights of the Child. In its answer to this questionnaire, the Bureau wrote that

“In the entirety of its existence, the Guantanamo Bay detention facility has held no more than eight juveniles, their ages ranging from 13 to 17 at the time of their capture (See United States Written Response to Questions Posed by the Committee onthe Rights of the Child, Answer to Question 12(a)).”

Yet, in light of the discussion above, the Guantánamo Bay detention facility has held no less than 12 individuals, their ages ranging from 13 to 17 at the time of their seizure. They are listed in the table below.

It follows that the State Department underreported, to the United Nations Committee on the Rights of the Child, the number of prisoners seized as children and transferred subsequently to Guantánamo. The figure reported to the U.N. committee does not even match the information made public by the Department of Defense .

4. What Do We Know About These Individuals?

Eight of the individuals mentioned in the table above have now been released.
  • Two are currently facing military trials as the first individuals in history to be charged with war crimes committed as children (Omar Ahmed Khadr and Mohamed Jawad).
  • One apparently killed himself in his Guantánamo cell (Yasser Talal al Zahrani).
  • One is still in Guantánamo, where he has repeatedly tried to kill himself (Muhammed Hamid al Qarani).

5. Could There Be More?

The information contained in the table in Section 3 is based solely on American military and diplomatic sources. They are corroborated, however, by a variety of international sources. The in-processing dates for the ten prisoners mentioned in Section 1, for example, is confirmed by the information about flight records presented in The Journey of Death, a report on “extraordinary renditions” prepared by the British charity Reprieve. And extant prisoner testimonies are also consistent with the information presented above.

As a matter of fact, if we were to incorporate the testimonies of former prisoners, the Red Cross, and other international sources, then, according to Reprieve (personal communication), the total number of individuals detained as juveniles and transferred to Guantánamo would exceed 46.

International testimonies on Guantánamo’s children will be analyzed in a subsequent report.

Judge tosses detainee confession of Mohammed Jawad citing torture

GUANTANAMO BAY NAVAL BASE, Cuba (AP) — A U.S. military judge barred the Pentagon Tuesday from using a Guantanamo prisoner’s confession to Afghan authorities as trial evidence, saying it was obtained through torture.

Army Col. Stephen Henley said Mohammed Jawad’s statements “were obtained by physical intimidation and threats of death which, under the circumstances, constitute torture.”

Jawad’s defense attorney, Air Force Maj. David Frakt, told The Associated Press that the ruling removes “the lynchpin of the government’s case.”

Guantanamo’s chief prosecutor, Army Col. Lawrence Morris, said he recognized how the judge made his decision and needed to study the ruling before making more comments.

Jawad, who was still a teenager at the time, is accused of injuring two U.S. soldiers with a grenade in 2002. He allegedly said during his interrogation in Kabul that he hoped the Americans died, and would do it again.

But Henley said Jawad confessed only after police commanders and high-ranking Afghan government officials threatened to kill him and his family — a strategy intended to inflict severe pain that constitutes torture.

“During the interrogation, someone told the accused, ‘You will be killed if you do not confess to the grenade attack,’ and, ‘We will arrest your family and kill them if you do not confess,’ or words to that effect,” Henley wrote in response to a defense motion to suppress the evidence. “It was a credible threat.”

Frakt said the ruling is a “further disintegration of the government’s case,” and that the Afghans’ descriptions of Jawad’s confession were never credible to begin with. He also praised the judge for “adopting a traditional definition of torture rather than making one up.”

The judge said torture includes statements obtained by use of death threats to the speaker or his family, and that actual physical or mental injury is not required. “The relevant inquiry is whether the threat was specifically intended to inflict severe physical or mental pain or suffering upon another person within the interrogator’s custody or control,” Henley wrote.

Hina Shamsi, an attorney with the American Civil Liberties Union, welcomed the ruling, but alleged “evidence obtained through torture and coercion is pervasive in military commission cases that, by design, disregard the most fundamental due process rights, and no single decision can cure that.”

Tuesday’s ruling comes a few weeks after Jawad’s former Guantanamo prosecutor, U.S. Army Lt. Col. Darrel Vandeveld, quit after what he described as a crisis of conscience over the ethical handling of cases at the U.S. base.

He said evidence he saw — some of which was withheld from defense attorneys — suggested Mohammed Jawad may have been drugged before the 2002 attack.

This third report demonstrates the fraud and deception within the program strategy that CDFA Management used and is continuing to use to qualify for $100’s of millions of dollars of emergency taxpayer funds, which were intended for real emergencies.

CDFA’s main method of fraud isFear and Solution.” CDFA Management creates a false fear and then comes to the rescue with a solution. The false fear is the nearly harmless moth that CDFA characterizes as the moth of mass destruction. CDFA falsifies that eradication is necessary and possible, and extorts taxpayer emergency funds for the solution. It is very much like paying the CDFA to keep the sky from falling.

The second method of CDFA fraud finds the CDFA supplying other agencies with false information so that the work of other agencies results in conclusions that support the CDFA lies. Other agencies are generally innocent, but under pressure for immediate results with limited budgets and not suspecting CDFA deception, other agencies accept the information and data that CDFA supplies them.

The third method of CDFA fraud is to load the decision making processes with people who have something to gain by the fake eradication program going forward and exclude independent and honest analysis by scientists and others who are not dependent on or under the wing of CDFA.

The fourth method is repetition of message: “Safe,” “Safe,” “Safe,” “Safe,” “Safe,”
“Just a Pheromone,” “Just a Pheromone,” “Just a Pheromone,” “Just a Pheromone.”
It is interesting to learn that there is not a single drop of natural moth pheromone in the entire bogus eradication program, and not a single scientific document that concludes that any method used by CDFA in their program is safe.

The fifth method of fraud and deception is damage control. When the CDFA is caught lying, or the false information they deliver is found to be incorrect, A.G. Kawmanura, the secretary of the CDFA, makes the statement that they will need to communicate better, implying that the lies and deception were just a misunderstanding.

Currently, the theme of fraud that the CDFA is using is a classic example of the false fear that CDFA creates. After public hearings and courts convened and found that NO DAMAGE had occurred from this moth, CDFA has rebounded with the slogan: “Once the damage is seen, its too late.” CDFA uses this slogan to make us believe that LBAM is like a locust attack on our State or the wall of a dam breaking and that we should have fixed the crack ahead of the devastation. This is all scary stuff. But there is ZERO truth and ZERO relationship of LBAM to the fear scenario that the CDFA has created in their new slogan. It is without precedent in the known history of this earth that LBAM suddenly devastates crops, forests or backyard gardens, as the CDFA management would want us to believe.

Professor Chase is furthering the call for a truly independent State investigation of CDFA and the LBAM eradication program. An independent investigation into the CDFA LBAM eradication program will quickly demonstrate the erroneous messages delivered and the unnecessary LBAM eradication program perpetrated by CDFA. “An investigation will isolate the real scientists within the CDFA from the Management because the scientists at the CDFA will unlikely commit perjury to support the fraud and deception that has been delivered by CDFA Management to California’s agriculture community, elected officials, the press and the general population.”

Professor Chase’s first report (http://www.indybay.org/newsitems/2008/07/15/18516449.php) revealed the falsehoods CDFA delivered after June 19 when courts and public pressure stopped the CDFA from aerial spraying synthetic pheromone based pesticides directly on cities. Professor Chase’s second report (http://www.indybay.org/newsitems/2008/08/19/18527832.php) revealed the fraud and misinformation delivered by CDFA from fall 2007 until June 19, 2008.
